These Terms of Use govern your access to and use of Forged Sports services, including Forged VMS, hosted account and authentication pages, player profile features, venue operations tools, public booking experiences, APIs, and related software or services that Forged Sports makes available (collectively, the "Service").
1. Scope and relationship to other agreements
These Terms apply to individuals and organizations that create, access, or use the Service. If you use the Service on behalf of a venue, business, or other organization, you represent that you are authorized to accept these Terms on that organization's behalf.
Forged VMS is offered to commercial venue operators through a demo and direct sales process. A separate written order form, master services agreement, data processing agreement, statement of work, or other written agreement may govern a specific commercial customer relationship. If those written terms conflict with these Terms, the written customer agreement controls for that customer relationship.
2. Eligibility and account registration
To use the Service, you must:
- be legally permitted to use the Service;
- provide accurate, current, and complete registration and account information;
- use an email address and other contact information you control or are authorized to use; and
- complete any required verification steps before using restricted features.
You may not create an account by impersonating another person or by using credentials, device access, or contact information that you do not control or have permission to use.
3. Account security and verification
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must keep your password secure and safeguard access to the email inbox used for account verification, password reset, and other security messages.
Forged Sports may require you to verify your email address, rotate browser sessions, invalidate outstanding authentication artifacts, or re-authenticate in order to protect the Service, your account, or other users.
You agree to notify Forged Sports promptly at help@forgedsports.co if you believe your account, password, or sign-in email has been compromised or accessed without authorization.
4. Venue Management System commercial terms
Forged VMS is a Venue Management System for commercial golf simulator venues. It may include tools for bay operations, booking workflows, player profiles, business intelligence, integrations, waivers, leagues, and related venue operations.
Unless a written customer agreement says otherwise, pricing, subscription details, service levels, cancellation rights, refunds, implementation services, and customer-specific support commitments are handled through direct written agreements between Forged Sports and the applicable commercial customer. The public website does not create an online checkout purchase, renewal, refund, service-level, or support commitment for Forged VMS.
5. Acceptable use
You may use the Service only for lawful purposes and in accordance with these Terms. You may not:
- violate any law, regulation, or third-party right;
- attempt to gain unauthorized access to accounts, systems, APIs, or data;
- interfere with the security, performance, availability, or integrity of the Service;
- circumvent rate limits, authentication controls, or access restrictions;
- introduce malware, malicious code, or harmful automated traffic;
- reverse engineer, scrape, benchmark, or exploit the Service except as expressly permitted by law;
- use the Service to harass, abuse, threaten, defame, or infringe the rights of others; or
- submit illegal, infringing, fraudulent, unsafe, or otherwise prohibited content.
If Forged Sports provides API access or customer-specific integrations tied to your account, you must comply with the technical documentation, token usage rules, and operational safeguards associated with that access.
6. Profiles, venue data, and user content
The Service may allow users or venue operators to create or manage player profiles, booking records, gameplay activity, bay assignments, waivers, league information, support requests, uploaded media, notes, and other operational content. Content and data submitted through the Service remain subject to any rights of the submitting user, venue, organization, or applicable law.
By submitting content through the Service, you grant Forged Sports a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and process that content solely to operate, secure, maintain, support, and improve the Service.
You are responsible for ensuring that the content you submit is accurate and that you have all rights and permissions necessary to submit it. Forged Sports may remove or restrict content or access that violates these Terms, applicable law, or the rights or safety of other users.
7. Customer-enabled integrations
The Service may support integrations with simulator software, booking tools, point-of-sale systems, reservation systems, analytics tools, or other venue-selected systems. Integration availability can vary by customer, environment, provider, and rollout stage.
You are responsible for ensuring that you have the rights and permissions required to connect third-party systems to the Service. Third-party providers may impose their own terms, fees, limits, support policies, and data-handling practices.
8. Service availability and changes
Forged Sports may modify, improve, suspend, or discontinue any part of the Service at any time. Features may vary by environment, account type, venue, organization, integration, or rollout phase.
The Service may not always be uninterrupted, error-free, secure, or available at a particular time or location. Customer-specific service commitments, if any, must be stated in a separate written agreement.
9. Service communications
Forged Sports may send account, security, verification, password reset, operational, support, and other service-related communications by email, in-product notice, or another channel made available through the Service. These communications are part of the Service and are not marketing messages.
If Forged Sports separately enables a transactional SMS or similar verification workflow, message frequency will vary based on your activity and message and data rates may apply. Reply HELP for help and STOP to cancel where those replies are supported by the messaging channel.
10. Third-party services and venue policies
The Service relies on third-party infrastructure and service providers to host, secure, operate, support, and deliver the Service. It may also connect to third-party systems selected or authorized by a customer.
Forged Sports is not responsible for third-party services, third-party content, external systems, or a venue's separate policies, house rules, waivers, or agreements. Those obligations are between you and the applicable third party, venue, or organization unless a written agreement with Forged Sports says otherwise.
11. Suspension, termination, and account deletion
You may stop using the Service at any time and may request account deletion where that option is available through the product or by contacting support. Deleting an account does not necessarily remove all records immediately; Forged Sports may retain certain information as required for security, fraud prevention, legal compliance, dispute resolution, or legitimate business recordkeeping.
Forged Sports may suspend, restrict, or terminate your access to the Service if we reasonably believe you violated these Terms, created risk or harm to the Service or others, engaged in fraud or abuse, or if continued access is not operationally or legally appropriate.
12. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGED SPORTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGED SPORTS' AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT PAID TO FORGED SPORTS FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association in Delaware, unless applicable law prohibits arbitration.
You and Forged Sports agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding, to the maximum extent permitted by law.
14. Changes and contact information
Forged Sports may update these Terms from time to time. If we make material changes, we may provide notice by updating the date on this page, sending an email, or displaying notice in the Service. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
